Co C. 3-14-60 Page Two PRECISE PLAN NO, 112 LOCATION:-"396 So' California Avenue Accept Street -Improvements (Post Office site) (W o R o Groscham) City Manager Aiassa: This is.a'portion 0 of Precise Plan No o ll2 0 'Howevdt, _ there is a strip of 100 feet without curb, gutters or storm drain between two improved sites -'on this plan, the. -- medical building and post office. Would the Council desire us'to con- tact the owners regarding improvement of that 100 foot portion, at an estimated cost.of $3,276,00? It would help to improve the parking situation in that area during the Christmas rush periods. Mayor Brown: It would make parking on a public street, City Manager Aiassa: At least it would give us curb and gutter which we do not have there now. Mayor Brown: Who will pay for it? City Manager Aiassa: The owner of the property. It is related because it is part of Precise Plan No. 112,- but the property has been chopped up because of various owners. Mayor Brown: Was this portion included in Precise Plan Noo 112? Public Service Director P�Pjsh: The bond we have is for the post office site, the estimate is for property to the north. It was, I believe, one Precise Plan but there has been many bonds. Mayor Brown: It's strange we accept a Precise Plan in pieces. Public Service Director Dosh: Most of the time we have developed similar large areas on a "piece meal" basis. Mayor Brown: Is the 100 feet not improved included in the original Precise Plan at one time? Public Service Director Dosh: Without the file on it I cannot answer as to what properties were entailed in the Precise Plan, Mayor Brown- If there was one Precise Plan for all,, the property, this should have been im- proved long ago since we have acted on, part of the Precise Plan and this should have been enforceable adjacent to the street whether, built on or not, if developed under one Precise Plano I think this should be held over until we check the Precise Plano It was consensus this be done. ® Just prior to the end of the meeting Mr. Dosh presented the plan rela- tive to the discussion and the matter was clarified and the motion was made as follows: Motion by Councilman Pittenger, seconded by Councilman Barnes and carried, that street improvements in Precise Plan No, 112 (396 So Cali- fornia Avenue - Post Office site) be accepted and authorizapion given for the release of Travelers Indemnity Company Bond No. 694807 in the amount of $3,500.00, C. The City Manager stated that he would recommend this item be deleted and held until the Council meeting of March 28tho It was consensus this be done. Set for hearing this date by Resolution of Intention No. 1757 adopted by the City Council at their regular meeting of February 8, 1960. Mayor Brown: The hour of 8:00 o'clock Po M. having arrived, this is the time and place for the hearing of protests or objections against the improvement of Lark Ellen Avenue, et al. and others in the City of West Covina. Does the City Clerk have the Affidavits of Publi- cation, Posting and Mauling relative to'this hearing? City Clerk Flotten: We have the -Affidavits of Publication, Posting and Mailing relative to this hearing, Mayor Brown: I will entertain a motion to receive and file the affidavits. Motion by Councilman Pittenger, seconded by Councilman Barnes and carried, that the affidavits be received and filed. Mr. Aosetti, of the office of L. J. Thompson, presented his report of assessment spread and estimated cost. It was indicated the residential area would have 12 inch pipe at estimated cost of $5.63 assessable front foot and the commercial zone would have 15 inch pipe at estimated cost of'$7,Q$ assessable front foot. Has the City Clerk received any-4kitten • or oral protests or objections against the proposed improvement? City Clerk Flotten. We have received no written or oral protests. Mayor Brown. Is there anyone present who would desire to speak on this matter? Mr, Frank Delay. I do not protest but I would like to ask a question regarding easements. I have never been approached or spoken to about easements so I am concerned as to how this is going to be processed and get property easements in a commercial district. City Manager Aiassae We have four major property owners to approach for easement. We have met with two owners who have committed themselves to easements and we have two more easements to obtain, Mr. Delay. Why is the cost 16,ss in the residential area than in the dommercial area? There. are no public streets to go through and. the replacing of pavement is not to be compared to that of residential areas. Mayor Brown. There will be 12 inch pipe placed in the residential area and 15 inch pipe placed in the commercial area. Since there are nogprotests I would entertain a motion this hearing be continued to March 28, 1960 so as to include the Resolution relative to proposed change of work and acquisition in this district. Motion by Councilman Heath, seconded by Councilman Barnes and carried that this protest hearing be continued to meeting of March 28, 1960. ZONE CHANGE NO, 153 LOCATION. 140-150 Roberto Avenue and ZONE VARIANCE NO. 308 1523-1545 Dennis Place (between Yaleton PRECISE PLAN OF DESIGN and Conlon Avenues, north of Harbert St.) NO. 215 (Frank.DePietro) APPROVED Request for reclassification to R-3b, two-story multiple dwellings, modifica- tion of yard areas; adoption of precise plan. Denied by Planning Commission Resolutions No. 870, 871 and 872. Appealed by applicant on February 18, 1960. Maps were presented by the City Clerk who stated that there is on file proof of publication of the notice of this hearing in the West Covina Tribune on March 3, 1960. The Resolutions of the Planning Commission • were read. Mayor Brown opened the public hearing and stated that all those desiring to present te4timony should rise and be sworn in by the City Clerk. Sciter There are a group of us -surrounding 1542 W,Workman this territory with homes on Yaleton, West Covina Conlon and Workman objecting -to this proposal. We would present this obj'ec- tion, in a form of a petition, to -the Council. We feel we should be entitled to privacy and do not like to have a'second story building behind us, nor do we like the idea of garbage disposal areas in the rear which would not be desirable. These are very short -'.lots° 'It would make this very close and there is also, an easement for telephone poles which would take out some more area. We would like a block wall constructed before any streets are so as to inhibit the dirt, dust and noise of this work and also to provide safety for our children, Mr, Ho Robinson 203 Yaleton West Covina am also concerned with the quite enough traffic as it I am concerned with privacy. As I explained at the Commission meeting I have a swimming pool and I feel that to have these dwellings right behind me will invade my right to privacy and I traffic this use could generate. He is asking us to subsidize an investment he has made because he states he can't build this property for single family use and so he desires these variances to put up apart- ments which I feel will devaluate our property. Why should this be permitted when all along the front has C-1 or R-3 of 250 feet and this is proposed to go into the middle of properties and isolate property on Yaleton having it bound on two sides by R-3o Mrs, A. Emily I own Lot 92 and I went this afternoon to the property owners on Workman, Yaleton and Conlon and all indications were they would be willing to sign against a proposed double story dwelling but were willing to accept single story dwellings so that it wouldn't look down upon residential properties. There being no further testimony, the hearing was declared closed. Councilman Pittenger: According to this map the only two story apartment is on the west side which would abut Lot 34 and -would be at about 148 Conlon, There is no apartment on lots which would abut up to Lot 83 or 202 Yaleton or 149 Yaleton, no two story except that one area which would abut up to 148 No Conlon, so the complaint about look- ing into yards would not exist. The garbage disposal area being to the rear would not be practical, it would have to come out to Dennis which is forward, or to the south, of the Workman Avenue property lines , _Z do not know about the block wall request but I feel that it might be logical to doe Is that a condition, by any chance, Mr, Joseph? The recommendations were read, Mayor° Brown: Are these the recommendations of the Planning Department or Planning Commissalon? Mr, Joseph: Planning Department. Mayor Brown: The reason I ask is that lights and street have been in for some time. Mr, Joseph: I believe they are but we take the recommendations of the City Engineer as he suggests them and sometimes these _ items are repeated just to alleviate any chance of it not being carried. through, Councilman Heath: As I understand it, the opposition would be satisfied with R-3 if there were a block wall and if there were no addi- tional story buildings. I gathered from the presentations that there is no particular objection to this use so long as there is one story and a block wall along the north side of the property. Mrs. Smiley: We would go along with that. Mr, Scizer: We would go along with keeping the ... building stories down and the block wall, Mrs, Smiley: When it states back up to 12 feet of existing property on Yaleton does that mean 12 feet from our property to the back of the proposed use? Mayor Brown: There is 20 feet from the closest property line to the buildings - one story, Mr. Scizer: Can you give us 20 feet on the north side? Mayor Brown: 37 feet is the shortest distance there. Councilman Barnes: There will be single story 1wellingso Councilman Heath: Evidently there is no objection to -this if there is a block wall at the back of the property and no two story buildings to the north or east of the property. Mr, Eunice: I raised the objection to the projectio47 of this into Yaleton. Councilman Pittenger: Back of you is R-2 now, Mr, Eunice: I understand that, but this is pushing it further and we will be isolated. Mayor Brown: You are surrounded by R-2 and R-3o C, C. 3-14-60 Page Ten ZONE CHANGE NO. 153 _ continued Mr.,Eunice: Yes, but this is -increasing it If you had the whole map extending from"--'' Orange to Irwindale, above my property -now -is R-2, but he proposed to go up about 400 feet more and to go up center, and it would isolate use Mayor Brown: You are zoned R-2 right up to your .� property now and this traffic will not affect you at all. Councilman Barnes: Would you, Mr. DePietro, be willing to install the block walls prior to building. along the north qpd east side? Mr. DePietro: Yes, sir, Councilman Barnes: The block wall along the north side would actually be garages and I would assume you will install that first? Mr. DePietro: Yes, siro Motion by Councilman Heath, seconded by Councilman Pittenger and carried, that Zone Change No. 153 and Zone Variance No. 308 be approved., subject to the recommendations of the Planning Department. Motion by Councilman Heath, seconded by Councilman Pittenger and carried, that Precise Plan of Design No. 215 be approved, subject to this Precise Plan dated January 27, 1960. Mayor Brown called a recess. Council reconvened at 8:50 Po Mo ZONE VARIANCE NO. 306 LOCATION: 741 So Orange Avenue West Covina I (Northwest side of Orange Avenue, south Enterprises, Inc, of Garvey Avenue) APPROVED Request for detached, non -conforming sign in Zone C-1 denied by the Planning Commission on January 27, 1960, Resolutibn No. 862 Appealed by applicant on February 10, 19600 Maps were presented by the City Clerk who stated that there is on file proof of publication of the notice of this hearing in the West Covina Tribune on March 3, 1960. The Resolution of the Planning Commission was read, Mayor Brown=opened the public hearing and stated that all those desir- ing to present testimony should rise and be sworn in by the City Clerk, - IN FAVOR Mr. Grant Hoyt The sign we are asking for was actually West Covina Medical located, -In the same location prior to Center and Hospital some work that took place some three Administrator months ago when we paved the area in front of the medical center pharmacy and made room for landscaping. The sign had been perpendicular to the street and at the request of the Planning Commission we made allowance for a sidewalk running in front of the Co Co 3-14-60 Page Eleven t ZONE'."VARIANCE NO. 306 - continued -Mro-Grant Hoyt - continued: medical clinic. In order to do this we had to take up the sign we had. It was our design and intention at that time to then replace this sign parallel to the sidewalk at the sagie-location and to illum- inate it in the same manner as the hospital sign on top of the hospi- tal building, perpendicular to the Freeway. However, now it would _. seem that with the landscaping put in we would have to fiat this sign on the facing of the building in accord with the new sign ordinance' which will put the sign in a position not readily seen because of the trees in front of the pharmacy and the trees planted on the grass area in front of the medical center at the curve of the sidewalk as it goes into the underpass. Here is a medical clinic open 24 hours a day and we feel that people should know of its available facilities and could be looking for it at all hours of the day and night and so thus enable its identification for these people. We also wish to put on it a small sign hung beneath it, as on the PTior sign, the names of the doctors practicing at the medical center. There being no further testimony, the hearing was declared closed. Councilman Heath: How is this sign to be illuminated? Mr, Hoyt: Sign proposed is plastic faced, illum- inated with flourescent lights within an enclosed medical case and a single face sign. It will be similar to the sign on hospital building as we have. had the same company do this sign so that both signs would conform to each other. Councilman Heath: Are the Doctors' names illuminated? Mr. Hoyt: No. Councilman Barnes: It is similar to the size it was before? Mr. Hoyt: Yes. We have taken the approximate dimensions of the former sign and pro- jected this into an illuminated sign of the approximate same size and description. Councilman Pittenger: The basis for denial of this was the sign was in viOlationo Was it in viola- tion before? Mr, Joseph: I was not here when it was taken down but the recommendation now was purely on the basis of the proposed sign in relation to the present sign ordinance. It was felt the present sign, as proposed, would not conform hardship involved that the to the ordinance and that there was no so only recommendation would.be denial, Mr. Hoyt: In the.investigation I put into this prior to the original hearing, the sign was previously placed 7 or 8 years ago prior to adoption of your sign ordinance. Councilman Heath: I think this is another place where our sign ordinance needs revising. I see no objection to this sign and I think `trey need it to do business. r� L C. Co 3-14-60 ZONE VARIANCE NO. 306 - continued Page Twelve Mayor Brown: I think the people might need it And it would be more of an asset to the public than to business. Councilman Barnes: I would like to comment on the sign that is on the hospital which I think is a good one, and if this conforms to it on a smaller scale I feel it would be advisable to have it. I also think the doctors should be identified. Motion by Councilman Heath, seconded by Councilman Barnes and carried, that Zone Variance No, 306 be approved, ZONE CHANGE NO, 152 LOCATION: Northeast corner of Fairgrove. Dominco Marengo Avenue and Tonopah Avenue. (Sugar Constructibn Co.) TABLED TO 3/28/60 Request to reclassify from R-A, Area District II to Zone R-A, Area District I. Approved by Planning Commission Resolu- tion No. 869. City Clerk: I would refer Council to Item 21 on the Agenda which is the tentative map of this same area and suggest that possibly Council would desire to consider these items concurrently. We have on file proof of publication of notice of this hearing in the West Covina Tribune on March 3, 1960. Resolution No. 869 was read. Tomorrow morning I expect to put time in on the working drawings of the six units on Lot 16, which is one story, and this would convert Lots 17-and 18 on which the proposed recreation area is set out in the rendering. We present the rendering for Lot 15 which is the 10 unit, two story buildings with units from 900 to 1000 square feet in one bedroom use and somewhat over 1100 in two bedroom use. This 16 unit, which you see here, is the first of the 101 units which are proposed to be put on the property and will be used as sales kit and future pattern of our construction, Our financing is pretty well under way. We have our contractors fairly, well set,and when I came in for the Precise Plan for this recreation center it was with the thought of future planning because I am mindful of the comments made by Council of no recreation area having been pro- vided. This is more similar to private homes and not an apartment use as we usually know it. In designing these particular buildings and streets you will note there isn't a single driveway going up the side of any of these buildings; everything is served through rear alleys to pre- vent car noise disturbance to residents. We have no power poles in front of this project and since it is a cul-de-sac street we didn't drop the swimming pool in.between the two 8 unit apartments so that the person who desired quiet on a Sunday morning would not have to be disturbed by those who might desire to use the pool on Sunday.morningso The objective of this project isn't for immediate development and this is the greatest "stinger" in our appeal. To make a point I would indi- cate that when you locate a -school you don't build a school, staff it, and then hope the children will come in, and the same is true of parks, basically. You designate an area for such uses and when the area is f Jlled then you have these uses put in and the same would be applicable to this recreation area. We spend $50,OOO.00 to have this complete recreation area in before we allow even a single person in the develop- ment and that seems to be way out in left field - how far can you go? We have a building designed as a recreation hall with facilities for rest and relaxations We have a community kitchen planned and underneath this hall will be a modern bomb shelter. This isn't a "gimmick" and I would read from an article in the Los Angeles Times relative to this • item as to whether we can survive an atom holocaust, which is written by theDirector of Civil Defense in Los Angeles, and giving us the possi- bility of what might happen in that case. We have three guest rooms for the use of Out-of-town guests if there is not room in the apartment of the people visited. This is part of the development and not a public thing, We have a card room, library, swimming pool, putting green, etc. In fact, what we are conceiving here might, perhaps, be a standard requirement in 1965 for such recreation facilities as a part of subdi- visions. We now make provisions for safety and sanitation and in this case we go a step further and provide for recreation. C. C. �-14-60 Page Fifteen UNCLASSIFIED USE PERMIT NO. 41 - continued Mr, Ned Gilbert - continued: We feel we are being "'hamstrung" for any such requirement -as -'has been stipulated. We feel that we are being held back by requiring this ­be built regardless of "what it costs him If'it is made as a prerequisite by Council we will have to abandon the project and come in at some later date. We do not propose to develop the recreation center now, it is not economically possible. There are two other conditions I would comment on which is sidewalks being a condition of this development. I am not sure that Council approved Item 2 that sidewalks be provided, Mayor Brown: If it is adjacent to schools it is an automatic requirement, Mr, Gilbert: The rest of the conditions are accept- able, but I would make a comment on Item 1, in that it is interesting that the Planning Department desires a listing of plant names that would be placed in this area. There is one otheritem in the first part of the study, Item 1, which says "subject property presently zoned R-A" and in the last sentence "construction on R-1 lots commence before development of R-3110 Either I have a misunderstanding on that completely or it implies, as I under- stand it, that all the construction is, is to develop the lots. I spoke with Mr. Dosh on this but reached no conclusions and if Council can clarify I would like to know about it. There being no further testimony, the hearing was declared closed, Mayor Brown:. I do not know how it was spelled out but I am sure that it was the intent that R-1 be built before the R-3�and that is customary if we give R-3 adjacent to R®1 - the building of the R-1 comes first. Mr, Gilbert: I completely misunderstood because I felt development meant manufacture of lot-s. Mayor Brown: We meant development of R-1, not as a lot Councilman Pittenger: The purpose of that is to be sure that we get the R-1 development. If you .cleared the lots, with curbs and gutters, you could come back in 3 months and get R-3 zoning, but we and the Commission wanted to be sure we had R-1 development there first. Councilman Barnes: You could develop all R-3, leaving 17 and 18 for late° development and the lots on the other end of the street for later development and some 2 or 3 years later ask for R-3 on those particular lots; this we wanted to prevent. Mayor Brown requested that the recommendations of the Planning Commis- sion and Planning Department be read. The City Clerk read the recom-' mendationso Councilman Pittenger: It would appear to me that Mr. Gilbert has come back to the trough again and I am wondering if he is in order? When we first discussed this, this was R-1 use all through here and we made C, Co 3-14-60 Page Sixteen UNCLASSIFIED USE PERMIT NO. 41 - continued Councilman Pittenger - continued- . the concession, and it was not a unanimous vote at"all, that it be-R-3 with R-1 buffer lots. I think you, Mr. Gilberts accepted'it on this - basis and I think you proposed this recreation use here instead-of'-1-1 on Lots 17 and 18. Now we are asking you to live up to'what you agreed to do. I wouldn't want to see you abandon the project -'but if you are not on sounder ground than this, you are not on sound ground at all. You have an elaborate recreation center here, with a fringe benefit'in the bomb shelter, but you could develop it very well without putting $50,000.00 in it, and at the same time show your good faith, and you can have your apartments without any trouble at all. I think the stipula- tions made are in good order with the original thinking on this matter. Mr, Gilberto When we said abandon the project we'were referring to this particular stipulation of the recreation center because we can't develop it whatever the cost because this is a stipulation before any units. Councilman Pittenger: You can put this on simultaneously with the 16 units. If economics do not permit it, it is your baby, you suggested it to usa I, for one, would not take this stipulation off without some other kind of proposal, Councilman Heath- I think what Councilman Pittenger has said has been well spoken and I agree. Councilman Barnes- As well as I like recreation for all such facilities, I think that the R-1 should be developed first. I know these two lots were stipulated R-1 because I was against the R-3 at the time and I am definitely against developing any of the property other than the R-1, first. These two lots were stipulated R-1 first and should be built that way in conformance with what the applicant agreed to before. Councilman Pittenger- R-1 or recreation, first. Councilman Barnes: There wasn't any recreation placed on it last year, only R-la Mr. Joseph- They were designated as R-1 lots. Mayor Brown: I feel the same way about this as does the rest of the Councilo These have to be developed R-1 first or simultaneously with the apartments. Motion by Councilman Pittenger, seconded by Councilman Heath and carried, that Council confirms and upholds the action of the Planning Commission regarding the recommendations and stipulations in regard to Unclassified Use Permit No, 41 and Precise Plan of Design No. 213. Councilman Barnes voted "No" in that he does not go along with what has been approved and proposed. One -phase at a -time will be taken in completing the center, as funds become available, with the next phase to complete all structural work with the building struc- turally sound and ready for limited use pending utility-installationso Indications were that fund raising projects were now being planned which will enable the committee to go out for bids on the next phase of the work within 6 months and request was for permitting the committee to proceed with structural completion. Mr. James Maul held a discussion with the Council relative to this matter and it was the indication of all members of Council that -any action on this request would be withheld until it is fully indicated the money actually is on hand to go ahead with it,and when that is indi- cated there should be no delay on Council's part in permitting them to go ahead with the next phase. Mr. Maul stated he would notify the committee but would leave the plans on file. BARD DISTRIBUTING CO, Request to operate an amusement game described as a coin operated baseball game in Eastland Bowling Alleys. Mr, Hastings, representing the Bard Distributing Company, indicated this could be properly controlled and was being permitted in quite a few cities in surrounding area. The City Attorney indicated that Mr. Hastings had checked this matter with him and it had been indicated that regardless of the ordinance and the intent, it would be whether Council wanted this or didn't want it and if they did, the Ordinance could be amended eith'x° way to clarify the matter. Council opinion seemed not to be too favorable to such proposed uses because of the danger of gambling and young people getting involved in such games of chance, but they were interested in having Mr. Hastings meet with the City Manager relative to the ordinance regarding control in this matter, with copies sent to Council, and to check into this with neighboring cities and their opinions on it. ZONE VARIANCE NO, 60 Public Works improvements report. South Hills Country Club Street improvements, curb and gutter. City Manager Aia.ssa: Council has copies of this report. This shows improvements as proposed by the City under their Zone Variance No, 60. I had a joint meeting with three members of the Board of Directors of the Country Club and we reviewed the entire provisions of Zone Variance No, 60. At the time it was approved all you listed was improvements but not the extent of improvements, which usually falls under curb and getters and a portion to match existing pavement. There is consider- able amount of improvement involved and that portion required from the CounlryClub property would be tied to a very poor existing street struc- .._tur,e..'_In the middle of the street. The existing pavement isn't good and as you go from Vine, south, there isn't a uniform grade or anything. I have here the proposal prepared as a result of our meeting, subject to confirmation by Council and the Board of Directors of the Country Club. The problem is that there was originally a 60 foot R/W from Vine south to Lark#ill Drive and now we want 80 feet so they aregranting additional R/W which is not a part of Zone Variance No. 60. 1 did not, at this time, want to get involved with the other west side but desired to complete this project with the Country Club as per Zone Variance No. 60. Councilman Heath. I think we could settle this part of it but hold it up until we get a settlement on the other side. Mayor Brown indicated he was opposed to this since he felt it had been pushed through at an adjourned public meeting at which all of Council was not present; that he was not in favor of the increase in wages since if there were more wages to be 'involved the office of City Clerk should be a full time job and that the City Treasurer should not be an elective position and should have been on the ballot to abolish it. It was indicated if this matter was not taken care of at this time, it would not be able to be brought forward for another four years. It was felt the increase was not out of line, particularly for the City Clerk, and that although Mayor Brown indicated such type raises should be given by the public and not by Council it was stated by Councilman Heath that he felt that Council knew better than the public,who would only really be voting on something blind in such a matter, as to just how much the job does entail, which the public does not. Motion by Councilman Pittenger, seconded by Councilman Heath, that said Ordinance be adopted. Motion passed on roll call, as follows: Ayes: Councilmen Heath, Pittenger, Barnes Noes: Mayor Brown Absent: Councilman Mottinger aMayor Brown voted 1°No" for the reasons indicated above, Mrs. Van Dame stated that she had been trying to get more money for Mrs. Merry for a long time since Mrs. Merry is heavily bonded and handles a great deal of money, and she did not feel that $75.00 was too much for the work done. Mayor Brown indicated that there are other special considerations given. Councilman Pittenger: We should take Merced to Glendora and stop'it there and then you haven't changed it a bit. I think there has been good points made in that if we passed this Resolution there would be a stigma on the properties involved and we have no intention of placing it in next year's budget, or possibly not for two or three years. I do not think this amendment is fair to do to anybody; I had it done to me by the State and I didn't like it. Councilman Heath: I thank by doing'. -this we are penalizing people and that it is not right to do it until we are ready to buy and go ahead on it. Mayor Brown: The stigma has been on this for years, and was at the time it was purchased and built on, and is practically back to the original alignment. Motion by Councilman Pittenger, seconded by Councilman Heath and carried, that this Resolution be held for further study. The City Attorney stated that if Council determines to apply this only west of Glendora it should be indicated so that the Resolution is rewritten properly, RESOLUTION NO. Mayor Brown stated that an Ordinance had been passed in the City re- quiring people convicted of a felony to register, which he now believed had been indicated as unconstitutional. Councilman'Pit't`enger was of the opinion that he felt there was some merit in the idea of register- ing, regardless, and the City Attorney stated he would like to investi- gate the matter further so as to clarify just what has occurred. COUNCIL COMMITTEE REPORTS Councilman Heath: On the vouchers I believe we are paying for the fire engine. When did we accept it? City Manager Aiassa: The pumping test was approved by the Board of Underwriters and all we want now is a grade test. We want it in the writing of the Fire Chief that it meets requirements and copies will be presented to you from the Fire Department on this matter. MAYOR -COUNCILMEN SCHOOL Berkeley,May 25 to 27, 1960. C-R ZONING Councilman Heath: At recent meeting of the Planning Commission they.went over the C-R zoning, I stayed to hear what might be done in the matter concerning the specifications that might be written and then I got into a discussion with the various owners outside the chambers. They indicated they wanted this Council to pass this proposal because they had worked with it for so long and knew the background of it, rather than letting it go before a new Council. Already one of these persons had gotten a 30 day extension on escrow and they felt if there was no answer given the whole thing might be lost. In talking with the owners they indicated they were all in agree- ment with the new zoning proposal and asked it be put through as rapidly as possible. I worked with Mr. Williams on this and he figured this out to the closest time to work it out before election.. I asked the Commission if they would consent to a special meeting to'help.get this thing through and they stated they would. Councilman Pittenger had left the building and Mr. Aiassa wasn't here the next day and being on the committee for this C!-R'zoning I composed a.letter-^hoping that it would be a suggestion as to how we could take care of this problem we had. Evidently the letter did not indicate too well what I was -really attempting to do and it would appear as though I stepped out of bounds on it and there would seem to be people who are irritated because of it. If Council knows of anyone offended by this I would gladly rescind the letter. Mr. Joseph: The Planning Commission has agreed to meet at 7:00 P. M. on March 28th relative to this matter. Councilman Pittenger: I feel there were members of Council to • talk with you about this thing at the time but I feel no action can be taken now as it has been advertised and I do not necessarily want to stop the schedule, but I only feel that instead of your signing the letter, Mr. Heath, at least three of us who were available should have done it together. Councilman Barnes: It was my feeling this was something we wanted to do but possibly the three of us who were available should have signed it. C. Co 3-14-60 Page Twenty -Seven. UPPER SAN GABRIEL Councilman Barnes: I am -submitting the WATER ASSOCIATION monthly report of the Upper Sari -Gabriel Water Association and would`like'to • have copies sent to the League of Women Voters, .DEMANDS APPROVED.. VAN DAME I object to the consolidation of so many large precincts in the City. Why so many fire stations in the City? Mayor Brown: If we have a population of 50,000 under national fire underwriters it would change the class of fire insurance which will run the taxpayer, over a 3 year period, some $300,OOO.00; so to keep this down we must put in more fire stations by next year. When we become an official population of 50,000, which I am sure shall be indicated when the census is finished, we will drop two classes more in fire insurance ratings and it will be much less in cost to increase the fire stations. We can't bring in substantial business unless we can give adequate fire protection, Mrs. Van Dame: Instead of buying property for parks why don't you fix up the parks you have? Mayor Brown: That's true, but we feel we must buy the land we need for such uses while we can get it. Councilman Barnes: I agree with Mrs. Van Dame. We'should be developing the parks we have for our children rather than buying lannd and leaving it vacant. Mrs, Van Dame: That's right, the children we have now will be grandfathers before they can use the parks. I called the Police Department about a Freeway accident and was told there was nothing they could do regarding it and I should call the State officers, How long has+this been going on? I didn"t even know the telephone number, although the Department offered to call for me, Mayor Brown: This has been in effect about two years almost to the date. Mrs. Van Dame: When sewers are in, is there a service charge such as gas, electric? Mayor Brown: No. C. C. 3-14-60 Page Twenty -Eight Mrs. Van Dame: The parking for the post office -is terrible and if you -couldn't park across the street I don't know what they°d do. The rear is always taken up by postal trucks and you can't get in as there's always some car blocking the alleys Since the blackboard is up the gadgets for holding the maps don't do the job. You need something to make them stick better. What about the loud speakers we were supposed to get for the Council Chambers? City Manager Aiassa: That was_.taken.out,of the,_budget before it was adopted. Mrs. Van Dame: What about those officers posing with you tonight, Mayor Brown? City Manager Aiassa: Those are reserve officers, which helps add two officers to our car patrol. They receive no compensation for their time on the Police force.
